It's the same old story, day after day we read about it, watch it on television or listen to it on the radio.
Nobody can agree on anything. We are told the banks need money, some 'Experts' say the money should be  directly loaned to the banks by the ESM (European Stability Mechanism), other 'Experts' say governments should take stakes in the banks, another to form a 'Powerful federal body' to independently manage assets, and so it goes on. In the meantime there is nothing we can do so let's not waste our time, lets get on with the jobs we should be doing.

ADVICE TO BUYERS

For those lucky people with the money, who have been living in the dark ages and don't know the pitfalls of buying a property in Spain, here are some tips. Always have documents translated before you sign, and make sure there is a cooling off period of 14 days. Take any documents back to the UK and discuss them with a Lawyer or financial advisor. Make sure the Spanish lawyer is independent and is not otherwise involved in the sale. Beware of lawyers recommended by the vendor, and in cases where you are buying a repossessed property, find out the history. Finally, if you need a mortgage go to a reputable bank.

TEACHERS ON STRIKE

If you haven't heard enough about strikes, here's another one, but this time in Spain. Spanish teachers went on strike against cuts in Education spending. A 3 billion cut in spending means a possible 100,000 substitute teachers could be lost, bigger classes and an increase in state university fees. This is all part of the government attempts to trim the public deficit. An experienced teacher said it was necessary to tell everyone what it means to cut education spending where education is is not as good as other countries. Sound familiar? So the grass is not always greener.

Bank overcharging for mortgage redemption

Did you know that more times than you think, you pay unnecessary  fees on your mortgage operations?

A few days ago we had a case in which the bank, Bankia, (formed by a previous merger of two banks), added an extra charge on the mortgage redemption ( Property Register cancellation) of our client  which, obviously, he was not obligated to pay. We are resolving this matter and have claimed the amount back from the bank.

Non residents Inheritance Tax Spain-Uk

 

ISD (Impuesto sobre Sucesiones y Donaciones) or Inheritance Tax is paid by the person who is left  the asset which  is in Spain. The State rules always apply to non-residents owning assets in Spain. 

 The worldwide estate of British expatriates who are UK domiciles on death will also be liable to UKinheritance tax, as well as to Spanish succession tax on chargeable Spanish assets. Any succession tax paid in Spain can be deducted from any UK inheritance tax liability on the same asset. 

Allowances are available depending on the relationship with the deceased or donor.

State Rules 

Group 1: Natural and adopted children and other descendants (such as grandchildren, great-grandchildren) under 21(Allowance €15,957). Where the inheritor is under 21 a deduction of  €4,000 for each year they are under 21.

Group 2: Natural and adopted children and other descendants aged 21 and over; parents and other ascendants (such as grandparents, great-grandparents), and spouses. (Allowance €15,957)

Group 3: In-laws and their ascendants/descendants, step-children, brothers and sisters, cousins, nieces and nephews, aunts and uncles. (Allowance €7.993).

Group 4: All others including friends or unmarried partners. (Allowance Nil). 

  Succession taxes varies from 7.65% to 34%.

Apply for the NIE with a power of attorney

Spain will accept again (from last Friday) power of attorneys granted to lawyers for the purpose of applying for NIE certificates on behalf of their clients, so foreigners will not need to come just for this purpose. It is good news. 

DEBATE ABOUT A “DACION EN PAGO” SPAIN

During the last years of the Twentieth Century and first years of the Twenty-first, the economic boom in Spain pushed many Spanish citizens to invest in property. Other nationals, such as British and Germans, joined the cause attracted by the weather and low prices. At that moment the Spanish Banks facilitated these acquisitions, they offered a lot facilities to get a Mortgage, without taking into account the real economic capacity of the clients.

In 2007, with the advent of the global economic crisis, strengthened in Spain by the bursting of the housing bubble, many people were affected by drastic cuts in their incomes and in other cases loss of their jobs. Many of them had signed mortgages and were required to pay high monthly payments that under no circumstances they could afford.

Today, as a result of this situation, it is estimated that some 300.000 open Court proceedings have been issued and approximately 150.000 of these have ended in eviction. So there are numerous affected families where, in spite of having lost their homes, they still have to repay any balance due on the mortgage after the property has been sold or repossessed by the bank. Contrarily to what happens in other countries, such as the USA, the mortgagor’s liability does not end with the handing of the keys and the sale of the property. The mortgage is still required to be repaid and this financial debt will continue after the loss of their house.

This untenable situation has generated public discussion about the applicability of the legal concept known as "dación en pago", which is used by a bank, before filing foreclosure proceedings, allowing the defaulter to offer the property to satisfy the total debt before starting the legal process. Of course, the position of the banks is contrary to this measure.

In that way, with the peer pressure, the Spanish Government approved on March 9, 2012, an Emergency Act to Protect Mortgagors without resources. This act highlights the “dacion en pago”, but provided that a number of very specific requirements are conformed with, such as  all family members being unemployed, mortgage payments that exceed 60% of the family income and the property being a single dwelling.

Also, those who conform to this criteria should follow a roadmap to reach the effective implementation of the “dacion en pago”, taking into account the differences that relate to house prices in the city where they live.

Therefore, it seems that the standard has not satisfied the demands of those affected by this problem, because the act has too many requirements that make the practical applicability of this residual “dacion en pago” barely impossible. Nevertheless, we should see how it develops in practice, as this could be the first step towards solving the mortgage problem in Spain.
